IRAN’S SUPREME LEADER SUGGESTS FURTHER RETALIATION AGAINST U.S., SAYING STRIKES ON IRAQ BASES ‘NOT ENOUGH’

Iran’s Supreme Leader Ayatollah Ali Khamenei suggested Wednesday that Iran would take further steps to escalate tensions with the U.S., saying military strikes carried out against bases housing U.S. troops in Iraq were not enough.

“They were slapped last night, but such military actions are not enough,” Khamenei wrote in a tweet.

However, the Iranian leader’s post appeared to counter previous remarks by Iran’s Foreing Minister Javad Zarif, which suggested that his nation did not plan to further retaliate against the U.S. at the present time …

… William Banks, a professor of law, public administration and international affairs at Syracuse University, cautioned against further escalation in comments emailed to Newsweek.

“This is an escalation for sure but retaliation, revenge, or reprisals are unlawful at international law, not that Iran abides by international law,” Banks said. “The risks are that the U.S. will play along and some escalatory act will be disproportionate to the circumstances, leading to something far worse,” he said …

The Soleimani Airstrike: An End to His Signature Middle East Strategy?

Less well-known than Al Qaeda’s Osama bin Laden or ISIS’s Abū Bakr al-Baghdadi, the covert Iranian commander Maj. Gen. Qassem Soleimani had widespread strategic influence throughout the Middle East. He was responsible for standing up and activating a clandestine infrastructure of organized armed groups from Hezbollah to Hamas and for ongoing instability and insurgency in Lebanon, Yemen, Syria, Iraq, Afghanistan, Kuwait, and elsewhere. It is for this reason that several terrorism scholars and expert observers—myself included—have identified the Soleimani airstrike as far more significant than that of Osama bin Laden or Abu Bakr al Baghdadi.

“Critics of this action will fixate once again on the Trump Administration’s strategy, positing the US as responsible for Mideast conflict and crisis. Some of these critics ignore Soleimani’s two decades of militant infrastructure-building.”

While the repercussions of his death for Mideast dynamics are still unknown, even in these polarized times, the defeat of Soleimani should warrant a clear-eyed recognition that his two decades of orchestrating a covert signature strategy for Mideast insurgency and instability has come to an end.

First, the facts as currently known. On Jan. 3, 2020, Soleimani—head of the elite, external clandestine Quds Force, a division of Iran’s Islamic Revolutionary Guard Corps (IRGC)—was targeted and killed by a US drone airstrike, authorized by President Donald J. Trump. The strike happened as Soleimani and four Popular Mobilization Force (PMF) members—including Kata’ib Hezbollah (KH) Commander Jamal Jafaar Mohammed Ali Āl Ebrahim (Abu Mahdi al-Muhandis)—exited their aircraft at Baghdad International airport.

The five has just arrived from Lebanon or Syria, signaling coordination between Iran’s IRGC and the Iraqi-state supported umbrella PMF, often called the new Iraqi Republican Guard. PMF includes more than 40 largely Shia militia and terrorist groups, including Iran-supported KH, the Khazali Network, and Badr Brigades.

While some commentators have pointed to a post-US strike escalation of tensions, the drone strike that killed Soleimani and company was in fact a response to KH’s provocative 31 Dec., 2019, attacks on the US embassy in Baghdad—a breach of international law—and its 27 Dec., 2019, attack on the Iraqi K-1 Air Base in Kirkuk, which hosts US Operation Inherent Resolve (OIR) personnel. During that attack, KH rockets—more than 30—killed a US civilian contractor and injured four US and two Iraqi military personnel. It is for these immediate precursor reasons that the Department of Defense has characterized the Soleimani strike as “defensive.”

Forgotten in recent news, however, were a series of highly provocative attacks since 2017 by IRGC across the region. Last year alone, these include the May 2019 Gulf of Oman oil tanker attacks damaged six commercial ships, including two Saudi Aramco oil tankers; the May 2019 Saudi pipeline attack and the Sept. 14, 2019, unprecedented drone hit on Saudi Aramco’s two major oil processing facilities at Abqaiq and Khurais; and the June 20, 2019, attack on a US RQ-4A Global Hawk surveillance drone for which Trump intended to respond but reversed his decision, instead requesting a United Nations Security Council closed-door meeting on Iranian regional escalation. This pattern is why former US military commanders in the region, such as Gen. David Petraeus, have framed the Soleimani strike as a need to reestablish “deterrence.”

From a broader strategic perspective, for those unfamiliar with the region, the killing of Soleimani uncovers plenty of questions about the region’s politics and conflicts: Why in the world would Iran sponsor an irregular militia to attack a sovereign embassy, which Iraq as the host nation is required to protect? Why would Iran support the targeting of a neighbor’s military airbase, particularly when the world’s most powerful military force is on base? Broadening the aperture, why would Iran—with Soleimani as its operational mastermind—ally with Russia to support Syrian President Bashir al-Assad, since 2012, in the Syrian Civil War with brutal atrocities against his own people? Moreover, why would Iran seek to destabilize Yemen—supporting the Houthi insurgency—at Saudi Arabia’s doorstep, thus drawing the Gulf Arab states into the fray?

Welcome to the dynamics of proxy warfare and Soleimani’s signature strategy in the Middle East. At its core, Soleimani aimed to blend the power of the state (Iran, and its political power) with the dynamic activism of violent extremist and militant groups, much like the model of Hezbollah in Lebanon, as Middle East expert Ali Soufan observed. That strategy alone—where nonstate groups can draw on the power of a state—warrants a more disruptive response which utilizes all instruments of national power, including economics and kinetics.

Still one of the best strategic profiles of Soleimani is Dexter Filkins’s 2013 New Yorker essay, “The Shadow Commander” in which Filkins explains how Soleimani was shaped by the 1980s Iran-Iraq War (with its use of chemical weapons) and then tasked as early as 1998 to advance the 1979 Iranian Revolution and reshape the Middle East into the Shia Crescent zone of influence. As part of this vision, Soleimani went on—all at the same time—to help direct and fund Assad’s war in Syria, Hezbollah’s control of Lebanon, and the ongoing insurgencies against US and coalition forces in Afghanistan and Iraq (since 2001).

Soleimani’s endgame was to reshape the Mideast into a zone of Iranian influence, thus, advancing the Iranian revolutionary flame ever forward. While this goal is by no means unique to Soleimani—Iran’s Supreme Leaders share this core aspiration—what was unique to the general was his powerful execution of this goal by building a vast covert organizational infrastructure of dozens of Iran-backed militant and terrorist organizations. These proxies and special groups have been increasing at rapid rates due to fighting against US coalition forces in Afghanistan and Iraq, but also in Syria and against Islamic State.

In light of Soleimani’s long-term signature strategy, it is not surprising to see successive US administrations designate these proxy and covert forces as terrorist organizations. On April 8, 2019, Soleimani’s IRGC and Quds Force were both designated Foreign Terrorist Organizations (FTO) under Section 219 of the Immigration and Nationality Act, augmenting earlier Obama-era Treasury designations in 2007 and 2010. Likewise, in July 2009 under executive orders 13438 and 13224—covering those who threaten stabilization efforts in Iraq—the Obama Administration designated Kata’ib Hezbollah a terrorist organization, the only Iraqi Shiite militia so designated by the US. Soleimani himself was a “specially designated national” (SDN) since 1999, again in 2010 under EO 13382, with additional sanctions after his foiled plot to kill the Saudi ambassador in the United States.

Such tactics also were used at home. In early December the world witnessed an Iran “convulsed” by what The New York Times called its “worst unrest in 40 Years,” with anti-government protests across 21 cities. These protests were followed by Iranian President Hassan Rouhani’s “brutal crackdown”—with IRGC involvement—resulting in more than 1,500 protesters killed. Iranians were protesting rising fuel prices, the result of economic mismanagement and EU and US sanctions issued in response to IRGC provocations. These included the Countering America’s Adversaries Through Sanctions Act, which passed overwhelmingly by both houses in 2017 (including sanctions against Russia and North Korea).

There’s no doubt Soleimani will be replaced, but his successor will have very large strategic shoes to fill. Reports indicate that Iranian Supreme Leader Ali Khamenei has regrouped and will replace the head of its agile, covert militant network with Quds Force deputy Brig. Gen. Esmail Ghaani.

Governments in and beyond the region are collectively holding their breath, hoping that violence will not escalate. Some—such as Russia, Iran’s ally in Syria—criticized the US action and, in turn, praised Soleimani for having “faithfully served and defended the national interests of Iran.” Any realistic account must address the conflicting, multiperspectives in the region. In addition to celebrations among communities in Iraq, Syria, Lebanon, and elsewhere, journalist Kim Ghattas notes that Soleimani was not only a problem for the US, he “haunted the Arab world,” so his death has been greeted with often-quiet “elation.” While Iraq’s parliament will ask for the removal of US forces, some see the post-Soleimani moment as a win for a stronger Iraq. No doubt, US military servicemembers, directly targeted by the IRGC especially in Iraq, offer important insights.

Critics of this action will fixate once again on the Trump Administration’s strategy, positing the US as responsible for Mideast conflict and crisis. Some of these critics ignore Soleimani’s two decades of militant infrastructure-building or the audacity of Kata’ib Hezbollah to target its neighbor’s embassy and airbase. They also forget that KH Commander Muhandis—killed along with Soleimani—was the alleged mastermind of the US and French embassy bombings in Kuwait in 1983, as well as the assassination attempt on Kuwait’s emir in 1985. Such forces have been hard at work for a long time.

While we do not know what happens next, with Soleimani’s demise, Iran and its proxies have lost their strategic architect.

(WAER | July 17, 2019) With the Iran Nuclear deal hanging by a thread, a Syracuse University national security expert says Iran is using it as a tool to push back against the US, Britain, and other allies to gain a stronger foothold in the region. Corri Zoli is a law professor and Director of Research for the Institute for National Security and Counterterrorism at SU.

“You have the Middle East/North Africa region going through this enormous transformation right now. Iran is trying to get leverage, trying to be an agent of change in that transformation.”

“They can create enough of a division such that the EU will continue to back their nuclear deal and keep giving them support. They can continue to try and beef up their economic standing, and still do their proxy war meddling in the region. Then they can ultimately achieve their ‘Persian Crescent,’ the idea that they will try to dominate the Middle East.”

Zoli says the nuclear pact is full of structural and policy limitations that allow Iran to push the limits. She says playing nice just doesn’t work with a pro-conflict actor like Iran that has repeatedly tried to destabilize the region. Zoli says the sanctions are a form of diplomacy, even if it seems to be ramping up tensions.

“It’s highly coercive. It’s highly hard power. But as an alternative to actual military intervention, it’s a very strong and powerful tool and the US is uniquely positioned to use it because we have one of the strongest economies in the world.”

Zoli says the Trump administration’s economic sanctions are strategic, if not unpredictable, and could reap results that evaded the Obama administration’s softer touch.

“The accommodationist strategy can be extremely risky. The more economic warfare strategy…not the soft power, but the hard power approach, can be more effective. Political respect is a wonderful thing, a very idealist conception. But many of these nations said ‘prove it.’ Then you’re in the realm of pragmatics. Unless you play in that realm, it’s very hard to get the policy outcomes that you want.”

ECONOMIC WARFARE AS A LARGER STRATEGY

Professor Zoli says the Trump Administration’s use of what she calls “economic warfare” with Iran and others seems to be part of a larger and perhaps effective approach to pressure countries into action.

“You’ve got all the hard power of economics, which is even more pernicious than war. You can really destroy whole economies. In a war, you can hurt certain areas of a country, but you usually don’t grenade the entire economy. Whereas with economic warfare, you truly can.”

Zoli acknowledges this runs the risk of ramping up tensions with Iran, which is being targeted for violating the nuclear deal. She says, however, that political polarization and personalities seem to distract from what might result in positive policy outcomes.

“You have the Middle East/North Africa region going through this enormous transformation right now. Iran is trying to get leverage, trying to be an agent of change in that transformation. The gulf monarchies, with the US as an ally and others, are trying to block that power move.”

Zoli says we’re seeing much the same strategy playing out with North Korea and its nuclear program.

“Where is the economic pressure on North Korea? China. There you’ve got the economic warfare web. The Trump Administratiion and his advisors know that North Korea is essentially a client state of China. Anything it decides to do or not do is going to be based on some kind of prior relationship with China.”

Zoli knows allies might be a bit disgruntled, but NATO’s European states are contributing more to their own defense for the first time in history.

David M. Crane Appointed Chair of UN Commission on Alleged Violations During Palestinian Protests

Syracuse University College of Law and Professor of Practice and INSCT Faculty Member David M. Crane has been appointed Chair of a United Nations Human Rights Council Independent International Commission of Inquiry into alleged violations of international law “in the context of large-scale civilian protests in the Occupied Palestinian Territory” that occurred during May 2018.

The protests—primarily in Gaza and East Jerusalem—came in the wake of the announcement that the United States would move its embassy to Jerusalem and coincided with the 70th anniversary of Nakba (the 1948 Palestinian Exodus).  The Guardian noted that May 14, 2018, was “the bloodiest day in Gaza since the 2014 war”. At the time, The Guardian reported, other UN human rights bodies—including UN Committee on the Elimination of Racial Discrimination—urged Israel to halt “excessive force” against Palestinian protesters, and Amnesty International accused Israel of violating international law. 

In his letter of appointment to Crane, UNHRC President Vojislav Šuc observed that the Commission has been formed as a result of the UNHRC Resolution S-28/1. In the Resolution, the Council decided “to urgently dispatch an independent, international commission of inquiry, to be appointed by the President of the Human Rights Council.” 

The Resolution grew out of a May 18 Special Session of the UNHRC, at which UN High Commissioner for Human Rights Zeid Ra’ad Al Hussein called attention to the “[a]ppalling recent events in Gaza.” She explained to the Council that, “Since … protests began on 30 March, 87 Palestinians have been killed by the Israeli security forces in the context of the demonstrations, including 12 children; 29 others, including three children, were killed in other circumstances. And over 12,000 people have been injured, more than 3,500 of them by live ammunition.”

Resolution S-28/1 also “Calls upon Israel, the occupying Power, and all relevant parties to cooperate fully with the commission of inquiry and to facilitate its access, requests the cooperation, as appropriate, of other relevant United Nations bodies with the commission of inquiry to carry out its mission.”

“The focus of the investigation is to be open minded, fair, and neutral,” says Crane.

The two other members of the Commission of Inquiry will be Sara Hossain, a Bangladeshi lawyer, and Kaari Betty Murungi, a Kenyan lawyer and human rights activist. The commissioners have been asked to convene a meeting in Geneva, Switzerland, “with a view to agreeing on terms of reference and methods of work, establishing contacts with relevant stakeholders, and preparing [a] programme of work.”

Yemen: A Crime Against Us All

In a bombing, the dust settles slowly over the strike zone. What emerges are grey images, living beings neutralized to monochrome. Bleeding from the ears, deaf, and dumb from the concussions the survivors walk about in a haze. These zombies are the first things you see staggering down the street away from the rubble behind them, rubble that is the tomb of loved ones, neighbors, and friends.

“For a decade or so, the rule of law prevailed regarding holding those who commit war crimes and crimes against humanity accountable. Yet we have slipped down a slippery slope. That political will is waning.”

There is no militarily necessary reason for the destruction, the strike carried out by one of the combatants who knew or should have known about the laws of armed conflict. The rules do not matter in most conflicts of the 21st century. Welcome to the dirty little wars that nip at the heels of civilization, a civilization grown weary of it all and who look the other way. It is just too hard to marshal enough political will to do something.

A powerless United Nations can do nothing other than to help ease the pain of air strikes by caring for the wounded and the terrified refugees. The once proud mandate of restoring international peace and security has changed to maintaining at best that peace and security.

The three nations that could restore that prominence, the United States, China, and Russia are its biggest challenges and all three could certainly live without the paradigm of peace set forth in 1945. All three of those nations over the past years are also the biggest human rights abusers led by strong men.

International Law has evolved over centuries through customary practice and the consent of nations to bind themselves to certain norms. Indeed the day-to-day actions in commerce, trade, and finance all hinge upon these norms. Over time, other norms that declare that human beings have rights to be free from want, fear, and to speak their minds and worship freely are now enforceable and carry an accounting if violated.

From all this just twenty-five years ago, modern international criminal law began. For a decade or so, the rule of law prevailed regarding holding those who commit war crimes and crimes against humanity accountable. Yet we have slipped down a slippery slope. That political will is waning and the use of the law to govern international relations regarding humanity challenged.

In this kaleidoscopic void, dirty little wars flourish like weeds in an abandoned lot. Yemen is one of those weeds thriving in the dusty haze of airstrikes.

The likes of the Yemeni conflict exists but for this condition and circumstance. A surrogate conflict backed by cynical nations vying for power and influence in the greater region that is the Middle East, the possibility of a peaceful resolution hinges on the rule of law. The Yemen Civil War, which had its roots in the political upheaval of 2011-2012, has since turned into a complex conflict among a central, recognized government and its powerful Saudi-led allies, an alternative government in the country’s north backed by Houthi rebels, and several terrorist groups.

Escalating in 2015, the civil war has created the world’s worst humanitarian crisis. An estimated three quarters of the civilian population have been affected by the devastation from warring parties on all sides. Death, disappearances, detentions, torture, displacement and famine are ravishing the country. A cholera epidemic is being exacerbated by raids on civilian populations.

Meanwhile, critical ports for delivery of food and medicines have been blocked. Arms and deadly munitions, funded by the US and UK, have proliferated. Secret prisons established inside and outside the country are detaining countless numbers of civilians, women, children, and aid workers.

The panel of experts, led by Rapp and Crane, will assess the situation on the ground in this stage of the Yemen crisis, and propose solutions drawn from fundamental international laws and standards.

“Living Proof”: Syrian Accountability Project Publishes White Paper on the Yazidi Genocide

Yazidi Genocide CoverCrimes committed against civilians during war can be especially heinous, but when those crimes are committed with planned intent to destroy an ethnic or religious community, international law applies the unique label of “genocide.” It is not a charge used lightly by the international community, although in recent times it has been applied to crimes committed during the Bosnian War (1992-1995) and Rwandan Civil War (1994).

Now, a white paper published by the Syracuse University College of Law-based Syrian Accountability Project (SAP) asserts that war crimes and crimes against humanity committed in 2014 against the Yazidi community by the Islamic State in Iraq and Syria (ISIS) also should be considered genocide. The report documents crimes perpetrated against the Yazidi community and calls on the international community to take “proper care of the living proof” of the Yazidi genocide and to begin the “strategic preservation” of forensic evidence that could be used in an international court.

As with past SAP special reports, the “Report on the Yazidi Genocide: Mapping Atrocity in Iraq and Syria” draws on the project’s six-year-long effort to document war crimes and crimes against humanity committed by all sides during the Syrian Civil War and associated conflicts. Working with open-source materials from available media and contacts within the region, SAP students are responsible for maintaining the project’s two main deliverables, the Conflict Narrative and the Crime Base Matrix. The former is a legally relevant historical narrative of the conflict, while the matrix’s intent is to provide case facts of representative crimes (as well as the relevant international or national legal standard for each crime) to guide a future prosecution team. In this way, SAP both advocates on behalf of victims and provides legal analysis to aid in the eventual administration of postconflict justice.

The “Report on the Yazidi Genocide” has been sent to SAP’s international clients, including the International Criminal Court, the United Nations, the US Congress, and leading human rights organizations. The report also joins related documents requested of SAP by London-based law firm Doughty Street Chambers and barrister Amal Clooney, who acts as legal counsel to Yazidi victims of ISIS’ crimes and to Yazda, a non-governmental organization that supports the Yazidi community. 

“The Syrian Accountability Project has become a relied-upon legal investigatory tool for the delivery of justice for the people of Syria and the Levant,” says Syracuse University College of Law Professor of Practice David M. Crane, who supervises the project. “The capacity of a College of Law student with a focused, properly supervised plan is unlimited.”

The Yazidis—an ethno-religious group of between 500,000 and 1.2 million people living primarily in Northern Iraq—are Kurdish-speaking and follow their own syncretic religion that combines aspects of Zoroastrianism, Islam, Christianity, and Judaism. The “Report on the Yazidi Genocide” alleges that, beginning in summer 2014, the group was targeted by ISIS and its campaign to “purify” the region of non-Islamist influences. The report details what it calls “grim incidences” of “incomparable brutality” during this campaign. More than 2,800 Yazidis were killed in this short time; 4,600 community members were abducted; 1,950 children were victimized; and towns and villages were blockaded or emptied of their residents. Women were kidnapped, raped, forced to abort fetuses, and sold into sexual slavery, while in a particularly abhorrent episode in August 2014, many children died of exposure on Mount Sinjar, where up to 50,000 Yazidis were seeking refuge.

“This has been a harder project to track than crimes committed in Syria during the civil war,” says SAP Executive Director and third-year law student Joseph Railey. “Narratives about sexual violence as a war crime are difficult to collect, and whole villages have disappeared, so those people cannot tell their stories. Nevertheless, this white paper helps clarify for our clients what kinds of information the Syrian Accountability Project has recorded beyond the case facts stemming specifically from the Syrian Civil War.”

While the report cross-references individual representative crimes with the articles of the Geneva Conventions, Rome Statute, and/or Iraqi Penal Code that they violate, it is the systematic nature of the crimes, along with ISIS’ stated intent to convert Yazidis to Islam, that raises the atrocities collectively to genocide. “The stories underlying these crimes provide the evidentiary support necessary to demonstrate that ISIS executed a systemic plan to destroy, in whole or in part, the Yazidi people,” the report states. “ISIS soldiers regularly demonstrated a specific intent to destroy the Yazidi people through their ideology and unabashed assertions for eliminating the Yazidi community.”

The report recognizes that many of the circumstantial evidence and news reports that SAP has collected are not legally sufficient to support a declaration of genocide, but it hopes that publishing these narratives will spur the international community to make an effort to preserve physical evidence of crimes. “Bringing ISIS to justice for genocide against the Yazidi community, at the domestic or the international level, will depend on the strategic preservation of forensic evidence,” the report concludes.

“What we are asking is that more recording of actual criminal evidence be done by the international community,” asserts Railey. “We are essentially saying, what happened was horrific, yet few people are talking about it. So we want to help draw people’s attention to the Yazidi situation and start a dialogue about what can be done.”

Qatar & the “Quartet”: International Blackmail

(Re-published from The Jurist | Oct. 11, 2017) Within the United Nations paradigm, state-parties settle their disputes peacefully and only resort to the use of force as a last measure. Several weeks ago four state-parties skipped the first step and used force against a fellow member state. That aggressive act consisted of embargoes, cyber-attacks, and trade and flight disruption, culminating in a list of demands by those states to lift those sanctions.

In 2017, it is hard to imagine that a member state would use force without a legal sanction by the Security Council or an appropriate regional body. The unilateral decision to do harm to a member state of the United Nations by other member states is an action that should be condemned and corrected. Most remarkably is how little has been done by the international community to correct the situation and restore international peace and security within the region. The silence is deafening.

The use of force by Saudi Arabia, Bahrain, the UAE, and Egypt (the Quartet) against Qatar would not have happened but for a new and unstable president in the White House. Past presidents, regardless of party, would not have allowed this to happen; and one would surmise that this Saudi led attack would not have even been contemplated by this Quartet of member states due to that leverage by the West. This quartet saw a political weakness and an opening and took it almost assured of the reaction by the West.

This action by the Quartet could most likely be the beginning of a series of “events” brought upon by a weakened and confused American foreign policy. The lack of leadership coming out of Washington is starting to weaken that international peace and security upon which the United Nations is grounded. Though international blackmail cannot be allowed to stand, the lack of discourse between the feuding parties will only exacerbate the situation. The recent demand by the UAE for Qatar to withdraw as a host of the 2022 World Cup is an example of the blackmail and the lack of interest in settling a dispute peacefully.

The violations of international law and norms committed by the Quartet against Qatar are almost too numerous to mention. Among the treaties violated are the Universal Declaration of Human rightsthe International Covenant on Civil and Political Rightsthe Arab Charter on Human Rights, as well as the Declaration on Principles of International Law Concerning Friendly Relations and Cooperation among States in accordance with the Charter of the United States, among several others. These violations could arguably amount to an act of aggression. The battlefield and the weapons used are not conventional, but an embargo and the use of cyber space as a weapon to do harm could be construed as an aggressive act.

Hence the dilemma the international community now faces, technology has shifted the concept of conflict to another dimension, cyberspace. Its use to do harm continues to manifest itself and the lack of regulation of this new battlespace causes muddled or ineffectual response …

Erdoğan on the Warpath with Germany Ahead of 2017 Elections

On Aug. 18, 2017, Turkish President Recep T. Erdoğan appealed to the members of the Turkish diaspora in Germany not to vote for four German major parties—the Christian Democratic Union, Christian Social Union in Bavaria, Social Democratic Party (SPD), and Alliance 90/The Greens—in the Bundestag elections on Sep.24, 2017. In his view, all four parties—along with German Chancellor Angela Merkel—represent hostile attitudes to Turkey and its interests.

Erdoğan’s words are another escalation of tensions between Germany and Turkey, one that has been going on for a several months. Since the 2016 failed military coup, Turkey has increased its foreign policy assertiveness, including this latest attempt to redefine its relations with Germany. But although it might cause further difficulties in political and security cooperation between both countries—in counterterrorism and the migration crisis—Erdoğan’s pressure probably will not have a decisive impact on the outcome of the German elections.

To better understand the ongoing tensions between Germany and Turkey, it is necessary to take a look at internal and external factors influencing relations between Berlin and Ankara over the last months., including the strengthening of the Turkish diaspora.

The German-Turkish Bilateral Situation

Bilateral relations between the two countries have been simmering for a while now, and recently tensions have come to a boil. Firstly, on June 2, 2016, the Bundestag passed a resolution recognizing the 2015 Turkish massacre of the Armenians as the crime of genocide. Secondly, in the aftermath of the failed military coup, Turkish law enforcement and its secret service began a reprisal against political opponents. This action, endorsed by Erdoğan, was criticized by Merkel and the other members of her government. Compounding the issue, Turkey arrested 22 German citizens of Turkish descent and charged them with conducting terrorist activity and espionage. Among them were Deniz Yücel, a journalist for die Welt; Peter Steudtner, a human rights’ activist; and Tanner Kilic, head of the Turkish office of Amnesty International. Additionally, at the beginning of 2017 German authorities refused Turkish demands to hand over 414 Turkish diplomats, high-rank-soldiers, and family members serving in Germany who had sought a political asylum in the country. In response, Turkey accused Germany of a lack of progress fighting the Kurdistan Workers Party (PKK) and the Syrian branch of the Democratic Union Party (PYD), both of which have a strong foothold in Germany.

Meanwhile, German newspapers—based on sources in the Federal Office for the Protection of the Constitution (Bundesamt für Verfassungsschutz)—have reported on an increase of intelligence activity in Germany by Turkey’s National Intelligence Organization (MiT). Turkey appears to have collected intelligence on top German politicians, businesses, and Turkish dissidents.

Finally, ahead of the Turkish constitutional referendum scheduled for April 16, 2017, German authorities at both federal and state levels suppressed Turkish politicians who wanted to conduct political rallies among the Turkish diaspora in Germany, a move that angered Erdoğan so much, he compared present-day Germany with the Nazi-era Germany.

Geopolitical Factors Affecting German-Turkish Relations

Pre-dating the above tensions, in late August 2014, Merkel and her government approved material and training support for Kurdish paramilitary units (the Peshmerga) fighting against Islamic State (IS) in northern Iraq and Syria. In response, Ankara refused to permit German transport aircraft carrying supplies to the Kurds to stop at Incirlik Air Force Base. This step forced the Germans to look for an alternative: the British RAF Base in Akrotiri, Cyprus. Later, on Jan. 29, 2015, the German parliament set up a 12-month military training mission by Bundeswehr for the Peshmerga in northern Iraq.

Germany also maintains two military contingents in Turkey within the framework of the multinational coalition fighting IS. The first of them was stationed at Incirlik, alongside US troops. German aircraft conduct reconnaissance flights over Syria and northern Iraq, while troops provide logistical support for NATO aircraft in the region. The second German contingent is a part of the Airborne Warning and Control System (AWACS) component in Geilenkirchen, Germany, which operates from the Forward Operation Base in southern Turkey. AWACS aircraft conduct reconnaissance flights over Turkey and the Mediterranean Sea. Although 17 NATO countries maintain AWACS, Germany is the most valuable contributor to the system.  

In June 2016, Turkish authorities rejected a request for Bundestag parliamentarians to visit German troops in Incirlik. This decision caused another diplomatic clash. Merkel, German Foreign Minister Sigmar Gabriel, and German President Frank-Walter Steinmeier heavily criticized the Turkish decision, and, eventually, as a result of pressure from Germany and other NATO member countries, Ankara agreed to permit the parliamentarians to visit, on Oct. 5, 2016. However, to avoid further disputes, Germany took steps to relocate its contingent from Turkey to Al-Azraq Air Force Base in Jordan. The relocation started in July 2017, but it will take a few months for the contingent to reach full operational capacity.

Unfortunately, the withdrawal from Incirlik has not ameliorated tensions between the countries. In July 2017 another dispute erupted over access to the Forward Operating Base in Konya. On July 13, 2017, the Turkish Ministry of Foreign Affairs rescinded its permission for a group of German parliament members, led by Bundestag Defense Committee Chairman Wolfgang Hellmich, to visit German troops there. This escalating tension caught the attention of NATO Secretary-General Jens Stoltenberg, who committed to resolving the dispute. Stoltenberg held talks with the foreign ministers of Germany and Turkey, proposing a consensus agreement to allow regular visits of German troops by Bundestag parliamentarians, who would receive the status of NATO visitors (a designation that means Turkey would not be able to halt their entry). On Aug. 8, 2017, the Turks announced that German parliamentarians, as members of a NATO delegation, would be able to visit the base on Sept. 8, 2017.

The Turkish Diaspora in Germany

The Turkish diaspora in Germany is 3 million strong, with 800,000 Turks holding German citizenship and 530,000 possessing dual German and Turkish citizenship. However, the diaspora represents only about 2.2% of all eligible voters in Germany. These numbers nevertheless allow the Turkish authorities to transfer to Germany certain political disputes and internal conflicts, including violent clashes between supporters and opponents of Erdoğan, which have taken place in the streets of German cities. Conversely, the political situation in Turkey is being influenced by the emigrants, whose support of Erdoğan is growing.

Influence of the diaspora in Germany is also fueled by Turkish intelligence, which provides support to Turkish nationalist organizations such as the Gray Wolves, the Turkish Federation in Germany (ADÜTDF), and the National Action Party (MHP), as well as combating the Turkish (Gülen Movement) and Kurdish opposition movements (PKK and PYD). MiT intelligence also appears to be running a propaganda and disinformation campaign targeting the German authorities and top politicians. For this purpose, it uses Turkish media outlets operating in Germany.

It’s worth mentioning that, although its overall electoral influence is small, the Turkish diaspora often has a high electoral turnout. In the last two Bundestag elections, Turkish voters went to the polls in high numbers: 71.5% (2013) and 70.8% (2009). In recent years, the center-left and left parties—such as SPD and the Greens—have dominated the Turkish vote. In the 2009 Bundestag elections, SPD received 50.2% and the Greens 31%. In the 2013 Bundestag elections, SPD acquired 64%, the Greens 12%, and the Left (die Linke) 11% votes.

Erdoğan’s popularity among members of the Turkish diaspora should not have a decisive impact on the outcome of the 2017 elections because of the negligible importance of Turkish votes in the context of the whole country. But Turkish votes might affect individual parties, such as the SPD, possibly undermining the party’s current position within the Turkish community and contributing to the party’s decline.

Conclusion: Erdoğan at the Poker Table

President Erdoğan wants to consolidate his support in Turkey. To achieve this goal, he is turning to foreign policy and foreign relations strategies with his country’s most important partners. According to Erdoğan, relations between Turkey and Germany remain asymmetric, and Turkey is the side that is being abused by its powerful counterpart. Therefore, Erdoğan thinks he needs to be assertive and to be seen as a powerful political leader who strongly articulates his nation’s interests.

Indeed, Erdoğan feels emboldened by his latest political successes, such as his Justice and Development Party (AKP) winning the 2015 political elections and the outcome of the 2017 constitutional referendum. He also continues the process of growing ties with Russia, which becomes a vital partner for Turkey and which, in his view, could be a substitute of Turkish relations with its partners from NATO and the European Union (EU).

Regarding geopolitics, Erdoğan holds a key card: he can moderate the migration crisis through stopping or allowing uncontrolled migrants from Syria to enter the EU. This migration flow is an essential factor in German politics, for the country has already taken 1.2 million migrants from the Middle East and North Africa regions. Conversely, Berlin could hypothetically put pressure on Turkey by using economic measures, freezing German direct investments in Turkey, for instance, or limiting the tourism industry by continuing issuing security alerts for German tourists planning visits to Turkey. Moreover, Germany, as the political and economic leader of the EU, can suspend the talks on Turkey’s accession to the EU. However, such steps will not be implemented before the 2017 elections, due to fears of protests or social unrest by members of the Turkish diaspora.

Another card Erdoğan holds is the role his country plays in the NATO coalition fight against IS. The United States, especially, relies on Incirlik Air Force Base, flying missions out of the base and storing tactical nuclear weapons there (within the framework of NATO’s Nuclear Sharing Policy).

US President Donald J. Trump might be considered Erdoğan’s “wild card,” allowing the Turkish president to continue his aggressive rhetoric against Germany. Since the beginning of his presidency, Trump has been paying less attention than his predecessor to citizens’ rights, political pluralism, and democratic values, while arguably focusing more on the efficiency of the fight against terrorism, in which Turkey plays a crucial role despite its severe violations of democratic standards. Lack of criticism from Trump has meant that that responsibility for criticizing Turkey has been taken up by Chancellor Merkel, who has in the past few years become Erdoğan’s main political enemy.
